In such cases, you will be informed and advised on more suitable channels to pursue the matter.<\/p>\n\n\n\n<h2 id=\"h-resolution\" class=\"wp-block-heading has-blue-color has-text-color has-h-5-font-size\"><strong>Resolution<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"margin-right:var(--wp--preset--spacing--50);margin-left:var(--wp--preset--spacing--50)\">The HCRA may seek to facilitate an early resolution between the complainant and the subject of the complaint to address the issue collaboratively.<\/p>\n\n\n\n<h2 id=\"h-additional-outcomes\" class=\"wp-block-heading has-blue-color has-text-color has-h-5-font-size\"><strong>Additional Outcomes<\/strong><\/h2>\n\n\n\n<p class=\"has-dark-color has-text-color wp-block-paragraph\" style=\"margin-right:var(--wp--preset--spacing--50);margin-left:var(--wp--preset--spacing--50)\">If a complaint is substantiated, the HCRA may take one or more of the following actions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"margin-top:0;margin-right:var(--wp--preset--spacing--50);margin-bottom:0;margin-left:var(--wp--preset--spacing--50)\">Require the licensee to complete additional educational courses.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-right:var(--wp--preset--spacing--50);margin-bottom:0;margin-left:var(--wp--preset--spacing--50)\">Impose restrictions or conditions on the licence.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-right:var(--wp--preset--spacing--50);margin-bottom:0;margin-left:var(--wp--preset--spacing--50)\">Impose an <a href=\"https:\/\/hcraontario.kzstage.com\/administrative-penalty\/\">Administrative Penalty<\/a>, similar to a fine, on the licensee.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-right:var(--wp--preset--spacing--50);margin-bottom:0;margin-left:var(--wp--preset--spacing--50)\">Initiate legal proceedings in provincial court for charges under the <ins><a href=\"https:\/\/www.ontario.ca\/laws\/statute\/17n33\">New Home Construction Licensing Act, 2017<\/a><\/ins>, the&nbsp;<ins><a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90o31\">Ontario New Home Warranties Plan Act<\/a><\/ins>,&nbsp;or the&nbsp;<ins><a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90p33\">Provincial Offences Act<\/a><\/ins>.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-right:var(--wp--preset--spacing--50);margin-bottom:0;margin-left:var(--wp--preset--spacing--50)\">In more serious cases, refuse, suspend or revoke a licence entirely.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"margin-right:var(--wp--preset--spacing--50);margin-left:var(--wp--preset--spacing--50)\">If a complaint involves potential violations of the <a href=\"https:\/\/hcraontario.kzstage.com\/conduct-requirements\/code-of-ethics\/\" data-type=\"page\" data-id=\"1147\">Code of Ethics<\/a>, the HCRA may refer the matter to the <strong><a href=\"https:\/\/hcraontario.kzstage.com\/discipline-appeals-committee\/\" data-type=\"page\" data-id=\"1124\">Discipline Committee<\/a><\/strong> which may order a licensee to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"margin-top:0;margin-bottom:0\">Complete further educational courses.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-bottom:0\">Fund educational courses for employees or arrange and pay for training.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-bottom:0\"><a href=\"https:\/\/hcraontario.kzstage.com\/administrative-penalty\/\">Pay fines<\/a> of up to $50,000 for individual licensees and $100,000 for corporations, payable to the regulatory authority.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-bottom:0\">Suspend or defer educational requirements or fines based on designated terms.<\/li>\n\n\n\n<li style=\"margin-top:0;margin-bottom:0\">Cover costs imposed by the HCRA.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-972","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v28.1 (Yoast SEO v28.1) -
